Maybe they just haven’t seen him before. I only know the neighbors who live in the next two houses. I’ve had plenty of strangers thinking that it was okay to walk across a little dam that separates a pond from the lake, but that’s our property and the no trespassing sign was there for all to see. I have found out that some are visiting the neighborhood, so there’s no way I would recognize them.

As to him taking their pictures and then using them to insinuate that they’re racists, invasion of privacy/false light may be in play.

“A false light claim is similar to a defamation claim in that it allows an individual to sue for the public disclosure of information that is misleading (or puts that person in a “false light”), but not technically false. The key difference is that defamation claims only apply to the public broadcasting of false information and as with defamation, sometimes First Amendment protections prevail.

Generally, a false light claim must contain the following elements: (1) the defendant made a publication about the plaintiff; (2) it was done with reckless disregard; (3) it placed the plaintiff in a false light; and (4) it would be highly offensive or embarrassing to a reasonable person.”

It’s one thing to take pictures in case you’re worried about being threatened or assaulted, but if that doesn’t occur, the pictures shouldn’t be published anywhere with any type of accusation that smears those in the photos.

Why? Their behavior is public. If they are embarrassed by it, they shouldn’t do it in the first place.
