Florida sports gambling fight heads to U.S. Supreme Court

TALLAHASSEE — Arguing that the outcome of the case could represent a “blueprint for expanding gaming outside of Indian lands,” owners of two Florida pari-mutuels plan to ask the U.S. Supreme Court to weigh in on whether a multibillion-dollar deal giving the Seminole Tribe control of sports betting throughout the state violates federal law.

A Washington, D.C.-based appeals court last week refused to reconsider a ruling that found the 2021 agreement did not violate the federal Indian Gaming Regulatory Act, which regulates gambling on tribal lands.

But a motion filed Friday by owners of Magic City Casino in Miami-Dade County and Bonita Springs Poker Room in Southwest Florida argued the decision conflicts with other appellate rulings and “enables an extreme shift in public policy on legalized gaming that, once started, may be difficult to stop.”

An important component to the argument is whether web-based gambling happens on the server or on the device used to make the wager.

The native tribes want to take over the horse racing industry?

Pari-mutual wagers are generally associated with horse racing (and dog tracks I suppose) but there maybe others as well when there are multiple entrants in a contest. The money bet on a race is put into a pool, from which the odds are calculated based on how much is placed on each contestant, with the house taking something like 17% off the top and then paying out to winning tickets according to those odds.

The way I read this is that the tribes have exclusivity to sports betting (football, hockey, etc...) but parimutuel facilities want in. Horse racing is separate.

Former congress-critter and owner of the Palm Beach Kennel Club (Tom Rooney) has a big interest in this I’m sure.

They already took the dogs away from him, maybe they’ll throw him a bone here.

The device-this was decided long ago when they outlawed offshore bookies that were state licensed and acting lawfully in Antigua Jamaica, UK, Australia, Costa Rica etc......

Nationally now, the lawful online sports books geo fence within their licensed state=the device again.

It’s worse than that. They had the ability to be in the same boat as Broward and Dade with gambling a few years ago. They were told to wait a few years and PB would get licensed. They waited. It never came to be.
