It wouldn’t surprise me if Rome would at least tacitly approve of the FBI’s activities.

The maxim of the law is "silence betokens consent," as we're told in Man for All Seasons.

Rome has been silent.

IIRC in that scene More successfully argues the other side of the maxim, at least in theory, causing RIchie Rich to have to perjure himself, culminating in the great line in subsequent scene “But for Wales?”.
