The Justice Department filed a lawsuit today against the State of Tennessee and the Tennessee Bureau of Investigation (TBI) for violating the Americans with Disabilities Act (ADA). The department previously notified Tennessee and the TBI that they violated the ADA by enforcing the state’s aggravated prostitution statute against people living with human immunodeficiency virus (HIV). That letter of findings detailed the minimum remedial measures necessary to address the discrimination.

The department’s investigation found that the state and TBI subject people living with HIV to harsher criminal penalties solely because of their HIV status, violating Title II of the ADA. Tennessee’s aggravated prostitution statute elevates what would otherwise be misdemeanor conduct to a felony because the individual has HIV, regardless of any actual risk of harm. A person convicted of aggravated prostitution faces three to 15 years in prison and a fine up to $10,000, while a person convicted of a misdemeanor charge based on the same conduct is subject to a penalty of no more than six months in prison and up to a $500 fine.

That sounds like, at the very least, reckless endangerment if the person knew of positive HIV status.

The Biden DOJ just sued Tennessee for making it a crime to knowingly transmit AIDS and HIV. They claim it violates disability rights.

The very act of equating civil rights based upon non-moral aspects such as skin color, race, ethnicity, with an immoral proclivity, based upon feelings, is itself perverse confusion.

Since feelings/orientation toward affirming the Bible and having a unique affection for true Christians is a result of being spiritually born again by effectual faith to the risen Lord and Savior Jesus Christ, then they should be protected from having to affirm LGBTQ and being punished for opposing it. After all, they were born again that way.

Conversely, replace the class of persons that these stats refer to with Christians, as a result of one of their consensual acts (baptism, the Lord's supper?) btwn 2 or more persons and tell me what the reaction would be.

It's not even about actual danger, but about the exposed persons rational expectation of danger.

If I point a gun that I know is NOT loaded at an unsuspecting person and pull the trigger, an offense has been committed. This is no different.
