It’s easier to understand that rules are rules. She complained that she knew the rules but decided the cruise ship was being too rigid. It’s also easy to understand that, in your case, the ship WILL wait if it is an excursion booked thru the cruise line. And it’s easy to understand that they make it abundantly clear that if you go rogue and find your own private tour, you are gambling that the ship will leave without you. Some people like to gamble..then complain when they lose.
As former US Navy, I lived in terror of “Missing Movement” which had very serious consequences.
We were able to see men, people who we knew personally, who went to the brig and reduced in rate because of it.
I never, ever, Ever, EVER put myself in a position to miss movement.
And yes. We did often see sailors running like mad to get on the gangway before it was pulled away, because on an aircraft carrier, they are NOT going to put it back in place to let you on board.
I have no understanding or sympathy for the passengers. You know the rules.
IF the Rum was high enough proof, it would kill the gems anyway!

Does the ship advertise or recommend this private tour? If they do then they are liable.”
That happened to my wife and about 20 other passengers off the cost of Mexico.
We had gone whale watching via the cruise line while our ship supposedly stayed in the Mexican port. We had purchased our whale watching boat tickets on and from the cruise ship.
They apparently got a warning that any cruise ships in port were at potential terrorist danger. During our whale watching tour.
Our whale watching tour was cut short, and we boarded our cruise ship at sea from our whale watching boat.
We had a local lawyer from our area on board the whale watching boat.
After all of us were safely back on board our cruise ship, the lawyer and a couple of us notified the Captain that we would not be charged for the trip and would get a refund as we returned to the states. A refund not a discount on any future cruises.
We went around the tip of south America on Holland America (Buenas Aires to Valparaiso). There were two long land tours but both ship operated., No problems. I have been carnival also. HA was far superior and no kids running up and down the hall at 3 AM
If you ever go to SA take time for Iguazu Falls, Spectacular with a huge Argentinian national park around them..
Good for you. We went on a cruise to Alaska last July and there’s nothing more nerve-wracking that they thought of missing the ship departure. It’s hard to put it out of your mind when you are ashore.

I should say-it is not that I am unsympathetic. I am. But actions have consequences.
That said, I have no doubt they will sue and be successful. We live in a world where large numbers of people think rules don’t apply to them.
At first, I thought these passengers were entitled whiners but I might have to reconsider when I see the 8 of them were willing to share THEIR cruise ship with thousands of others. (/sarcasm)
The ship would then take both groups.
But they don’t guarantee they’ll wait for the private tour

Board the ship excursion passengers, Leave the others at the dock.
Why? The ship has a duty to delay leaving port for the former, but not the latter.
I have a dear friend right now who is doing a world cruise on Holland America. He is right now in the Seychelles. He loves Holland America. Has done a couple of their world cruises already.
The duty only extends to holding departure. As long as the ship hasn't departed and they are boarding some, they have a duty to board all of them.

Correct me if I'm wrong but there is a limit to how long the ship will wait, because as you said the ship has departure deadlines. However, if the excursion is affiliated with the cruise line, arrangements will be made by the cruise line, at no cost, to get the passengers to the next port of call.
If that doesn't reek of entitlement, I don't know what does. In the military it's called missing movement and it's a court martial offense. Next time, be on time.
