I was not aware of this, but apparently ONLY AFTER the conclusion of trial testimony, the judge holds a conference with the prosecuting and defense attorneys to discuss the charge to the jury and it is THEN that the tiral judge issues the instructions to the jury. Poor Smith trying to bend the rules so he can get an appeal. Judge to experienced to fall for it.
