That's what I thought, but since there was no contact between her vehicle and his, nothing can be proven, even though he admitted it.

A confession is proof, I'd think. Even if he didn't sign a confession, you'd have the witnesses to that confession. If you have collision coverage, I imagine the insurance company would join in a civil suit to help recover damaages. (But I'm not a Texas or otherwise attorney, so that's only speculation on my part.)

Prayers lifted, for you and your daughter. Make sure she takes it easy. I'm not a doctor either, but I know that even a "minor concussion" means a head injury and shouldn't be trifled with.
