Obama Administration – Is it above the law?

Posted on 05/08/2009 7:44:11 AM PDT by street_lawyer

The essential question to ask is how much damage to the U.S. Economy will result from Obama’s running roughshod over the property rights of investors? Since January 2009 President Obama has expanded his powers unilaterally by bullying officers of privately held companies into agreeing to his demands. As a result we read in the Washington Post, one of the many newspapers that support this administration that “Political risk is becoming a growing concern for investors in the United States as the government plays a larger and more controversial role in private enterprise because of the financial crisis.”  ie: changing the rules of engagement in the middle of the battle.

According to the report, investors view Obama’s role as a subversion of the legal rights of investors by denying them the usual bankruptcy procedures. For almost eight years the Democrats have claimed that President Bush considered himself above the law, engaging in an illegal war, torturing terrorists at Guantanamo, and now the Democrats are threatening to prosecute those in the Bush administration who were involved as war criminals.

The Obama administration knows how to reward their friends who put them into office. The actions of this new world administration go beyond cronyism. Obama has decided that the United Auto Workers Union (UAW) should own 50% of Chrysler, when they only hold 20% of the bonds; aside from the fact that his has been tried and failed in the past, history does not teach this administration.

In kind words taking from the primary investors and giving to the UAW amounts to protecting the retired UAW workers, and their votes are crucial to future Democrat victories at the polls. Obviously to allow those workers to suffer financial loss would not be a good thing because it would expose the leadership of the UAW to criticism. Many experts credit the UAW for putting U.S. car manufactures into bankruptcy by forcing the car companies to pay retirement benefits that only the Federal Government would be able to afford by forcing taxpayers to pick up the bill; however, when it comes to the consumers, they are going to find the best deals, which means they will not pay more for a car than its worth just because the manufacturer owes on past commitments to its retirees.

The Chrysler case is not merely about retired workers, it is in fact evidence of what is to come. Ignoring existing bankruptcy laws amounts to steeling from investors what is rightfully and legally theirs. Bondholders, at least during this administration, should be weary of investing in any publicly held company where the Obama administration is likely to protect its constituents or the unions have a financial stake in the outcome in the event the company falters.

This threat to investors is not only where Unions are concerned, but any industry on the environmentalists’ hit list. ie: oil companies, coal mines, power generation plants and factories that use oil or coal, development in “environmentally sensitive” zones, banks, and other financial institutions that the Obama administration may decide to nationalize, are just a few sectors that will suffer in the long term.

A London publication entitled “U.S. political risks grow in financial crisis” made this observation: “President Barack Obama's attack on Chrysler debtholders who oppose the plan -- he described them as "speculators" who had endangered the automaker's survival -- only underlined the idea the government had no time for alternative views.” We are redefining the term “arrogan”t when it comes to Perennial politics.

Of course it is above the law. Just ask them.

They will tell you all about how it is for your own good, they know best and it is for the public "safety."

In answer to the question posed, yes, they are above the law. And that is why their final goal is to take over the Supreme Court as well. See below.

Look ahead just a little bit. In controlling banks and automobile manufactures “TheDivine One” and his apostles control their personnel policies. Guess what racial group members will not be able to get a job in a financial institution and in an auto manufacture?

“Obama Administration – Is it above the law?”

If you believe in a living, breathing constitution, you ARE the law. At that point, the law resides in the hand that holds the ink pen writing the law, NOT in a set of ideals, standards and built-in safeguards captured in one of the greatest documents in the history of mankind.

The answer to that question is a resounding “yes”. And not just Obama, but going back to the 19th Century, it is, or at least it should be taken for granted that the US President is, indeed, above the law.

Washington has no stomach to restrict a president for any crime, even so high as treason or murder. And it hasn’t for a long time.

Which is why they should be tried for treason as well, by failing to defend the Constitution they are aiding the enemies thereof, and thereby are themselves traitors.

“Obama Administration – Is it above the law?” What a silly question ... the media has repeated the affirmative action figure’s mantra ‘He won the election’ so the rest is of no conseqience, even that pesky once revered document, The Constitution. What a nuisance that old white guy stuff is! But since Barry won, that contract is no more anyway, John Roberts took care of that for the marxist messiah POIE.
