But the characterization of the individual mandate as a tax or a penalty will have virtually nothing to do with how the masses vote.
Whorealdo is trying to paint Roberts as clever because he gave the liberals what they wanted, which is not striking down the law. The liberals don't really care why he did what he did and it will never get filtered out to the masses anyway.
Well, that depends on whether Romney takes advantage of the opportunity he's been handed. Romney can press Obama on whether the I.R.S. has enforcement capability. Obama's screwed either way he answers. If Obama says the I.R.S. has the power to go after people for not buying insurance or paying the tax penalty, voters won't like that. And if Obama says the I.R.S. can't enforce the tax penalty, he's gonna have to explain how he'll make up for the missed revenue from people who refuse to pay. John Roberts made a horrible ruling, but he did give Romney a golden political opportunity.
