It depends on who can appeal a strikedown by a federal court to SCOTUS.
If the guv has the power then we're screwed.
If the people who started the referendum can appeal, then we've got a fighting chance.

Don't worry, the feds will ALWAYS find a way to screw the states over. There is no such thing as "states rights" any longer. The only "rights" that states have at this point is the "right" to pick the color of their flag (within federally mandated limits) and their state songbird (within federally mandated limits). Everything else is the sole domain of the federal government, mark my words.
