Umm, it's not his place to determine what the law SHOULD contain. Congress has every right to make this law.

Regarding this partial birth abortion ban, the people who really puzzle me in this whole matter are the "mothers". Today we have very effective and efficient birth control methods. So why do women not use them and avoid pregnancy and why would they let a pregnancy advance to the point where they would have their babies murdered? I really do not understand this. They've received due process- abortion is legal, in many states by statute.

If you think due process amounts to more than that, you've bought wholesale into substantive due process, where most of the extra-constitutional 14th Amendment jurisprudence comes from.
