Alabama Attorney General Asks Court to Oust State Chief Justice

The state attorney general asked a judicial panel on Monday to remove suspended Chief Justice Roy Moore from office for defying a federal judge's order to take his Ten Commandments monument off public display in the state judicial building. In a pretrial brief filed with the Alabama Court of the Judiciary, Attorney General Bill Pryor said Moore should be removed because he "intentionally and publicly engaged in misconduct, and because he remains unrepentant for his behavior."

Pryor's office is prosecuting Moore before the Court of the Judiciary on charges that the chief justice violated judicial canons. The trial-like proceeding begins Wednesday, and the court could remove Moore from office, suspend him, reprimand him or exonerate him.

Moore, who was suspended with pay when charged, expressed doubt Monday that he can receive a fair trial. He said he is concerned that cameras will not be allowed inside the courtroom for most of the trial.

The chief justice is accused of violating judicial ethics when he refused U.S. District Judge Myron Thompson's order to remove the 5,300-pound granite monument from the state building's rotunda. Thompson ruled the monument was an unconstitutional promotion of religion by government.

In August, the Alabama court's eight associate justices had the monument moved out of sight after a protracted legal fight.

The U.S. Supreme Court refused last week to hear Moore's appeal in the case.

I think elections are quite dull.....

That may well be.

But ballot boxes are always preferable to ammo boxes.

Yeah, I'm sure Moore would have happily let me wheel in a monument to my god to stand right next to his... < /sarcasm>

So, which false god do you worship?

by ANY means..... ANY means....

I think we don't need to fight a war. We just need to abolish those in the government and restructure it. Of course we will probably run them over or something, no guns are needed.

It is a huge font, and I've yet to figure out why you need to subject us to it when you can adjust what you see on your own monitor.

No, that would be an absurdity. What you are saying is that if you have a display with religious content in an Alabama public building, then the area becomes a free-for-all for displays of any other religious content.

It is not appropriate to take sound constitutional language and make up crazy ideas about what it means.

Moore didn't violate the Alabama Constitution. Read the Preamble.

But it is abundantly clear that the Federal judge violated the First Amendment to the U.S. Constitution by making a lawless ruling. He has no jurisdiction in such cases.

The statement was rhetorical, as Moore had already denied several other groups permission to put their religious displays in the rotunda.

Then they should try and win an election for Chief Judge in Alabama. Good luck.

Obviously, you are unaware of the United States Constitution, Article 6:

This Constitution, and the Laws of the United States which shall be made in Pursuance thereof, and all Treaties made, or which shall be made, under the authority of the United States, shall be the supreme Law of the Land, and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary Notwithstanding.

Checkmate. You lose.

It would be safe to say that this clause means the same as the First Amendment originally meant. No denomination shall be selected as the official Alabama State church.

Today President Bush pardoned GeekDejure for using large fonts while posting on the FreeRepublic web site. Knowing that GeekDejure is nearly blind, and further knowing that FreeRepublic Moderators continually refused to specify a maximum font size, Mr. Bush was pleased to pardon GeekDejure regarding any and all font size charges brought against him by any and all Freepers !!!

Thank You Mr. President !!!

Rest assured that you have my 2004 vote !!!

what Moore did violated the Alabama Constitution pretty clearly.

You have yet to cite the specific law that Judge Moore passed that violated the Alabama Constitution.

Read the First Amendment. Congress is banned from making any laws in this area. Judges, by making rulings that pretend to be based on law, but can't be by virtue of that Amendment, have simply become a law unto themselves.

Checkmate? Hardly.

Checkmate will be when all the craven cowards in Alabama politics who refuse to stand up to the ACLU and their minions are out of office permanently.

You won't have to wait long.
