They are not. They are saying that government may not promote specific beliefs. Government is not all of "society" or even "the public sphere", not by a long shot.

Oh really? They have said that public schools = govt, that all public courthouses = govt, public parks = govt (as they make their tyrannical ruling from a building emblazoned with the 10 commandments). Any public thing = govt. Case in point: Boy Scouts cannot use Balboa Park in San Diego becuase they were deemed a religious org. by the ACLU and their lackey fed. judge! Want to defend that? It's time to IMPEACH BAD JUDGES and throw them out on their ear.

SO the unjust judges of the American Judiciary have
sacraficed an innocent man to protect their prosecution
of corruption. There is truely nothing new under the sun.
And there is no Rule of Law in Alabama

I guess Charlamagne doesn't count.

Charlegmagne was important. However, he stated that he was the direct arbiter of divine law, while the Pope said that he was. Later, the emperors came under the Pope and this hold was not broken until Henry VIII.

On the other hand, America's founders said that the people, not one man, were the final arbiters of divine law and natural law.

The Ten Commandments is the basis of all law!
The Constitution protects the right to violate at least three of the ten.

I adore low class beginnings in people who rise out of it - however, in Moore's case, it appears that he never really shucked the victim attitude I see way too often.

I prefer power of people (individuals), not "the people" (collectivism). If it takes the power of the federal government to make local wannabe theocrats respect the law, then so be it.

That's what the US Supreme Court has said. The Fourteenth Amendment incorporated the First Amendment to the states.

But that's not what the 1st amendment clearly says.

I agree, but I'm not part of the US Supreme Court.

The SCOTUS has been applying the First Amendment to the states since at least 1925. For instance, in Gitlow v New York:

For present purposes we may and do assume that freedom of speech and of the press -- which are protected by the First Amendment from abridgment by Congress -- are among the fundamental personal rights and "liberties" protected by the due process clause of the Fourteenth Amendment from impairment by the States.

I agree with much of your premise, I believe it could be strengthened or weakened with additional detail... however:

Moore was elected by the people of the fine state of Alabama, not by a bunch of Lords In Robes

Aside from the first two, all civilized societies are based on the premises expressed in the remaining eight. Our society was founded and brought to the apex of its development (about 1940-1945) by people who believed in all ten.

#242...I've been testing what I believe here at FR for 4 years.

However, there seems to be a bigger influx of caustic, antagonistic spoilers more and more lately....

..and I'm tired of wasting my energies on the cyberworld, when perhaps....just perhaps, I can effect more change in the real world.

Having said that, FR is essentially a great place to find breaking news and intelligent commentary if one has the time to look for it

I just don't need a blood pressure eruption today over such as Chancellor Palpatine, or Hillary's Lovely Legs.

Not worth it.
