California Car Tax Refund Forms

Dear Fellow Car Owner:
As you probably know, Governor Gray Davis recently tripled the Car Tax that all California vehicle owners must pay in order to register their vehicles. The 300% increase will take effect for vehicle registrations due in October 2003, with bills likely being mailed to homes and businesses in August. On average, this illegal tax increase will cost car owners $158 per year.

The Car Tax increase is not right, it’s not fair, and it’s not legal, and I am taking steps to assure the tax is reduced. To that end, I have teamed up with the Howard Jarvis Taxpayers Association to file a lawsuit to overturn Governor Davis’ tripling of the Car Tax. The courts, however, will take some time to hear the case and eventually reverse the tax. In the meantime, there are steps you can take now to prepare yourself for an eventual refund that will also send a clear message to Davis’ administration that you are adamantly against increasing the Car Tax.

I have attached a link to The Department of Motor Vehicle’s (DMV) official refund form that you can send in with your car registration materials, assuming your registration expires in October 2003 or after. This will inform the DMV that you consider the tax illegal and will be expecting a refund once the tax is overturned. Also, the more refund requests submitted to the DMV, the more pressure there will be to lower the tax without legal action.

To complete the process please:

1) Click here and complete the Refund Form for each vehicle you register; 2) Be sure to click “other” in box 11 and insert, “Tripling the Car Tax is illegal. Pursuant to the lawsuit (case# HJTA v. DMV, Sac Co. Superior Ct. No. 3ASO3665) to overturn this tax, I am hereby requesting a refund.”

3) Mail the completed form with your vehicle registration renewal fee if your registration expires in October 2003 or after;

4) Make a copy of the refund form, your check and DMV bill, and save them for your records.

Don’t be discouraged if your refund is immediately denied, as it will likely take a year or more to overturn the tax. But by submitting your claim, and keeping a record of your overpayment, you will be establishing your claim for a refund. Hmm, I paid (boy, did I pay!) on oct. 31. Wonder what hoops I'll have to jump through to get my refund? The linked form was to have been sent in with my reg., right? Well, its too late for that...

I think it's in everynoe's best interest to flood the DMV with calls, emails and letters asking DMV the proceedure for requesting a refund and the proceedure for payment of a renewal, costed under the old system, but not yet due.

A DDS attack would probaly hasten changes in the renewal amounts.

Mine was due in June of this year, before the tripling. I paid $219, would have been $583 under the tripling rules.
Still a ripoff; probably higher than the majority of states.

It's a ripoff, alright.

Interestingly enough...I heard a piece on the radio today that said new car sales in California have been down 30%+ since the tripling of the tax. That alone has cost untold amounts in lost tax revenues paid to the state. So tripling the tax did not have its intended effect; it actually cost the state money. gray davis is an idiot.

You have no faith. Seriously. When everyone said Arnold would not be able to do it legally, when everyone said he would not, should not do it because of the deficit, he did it. Not the second day, not the first week. The first day!

Do you believe he is going to repeal this and then allow a bureaucratic nightmare with refunds? Not hardly.

Get the form, fill it out and wait for your check. Let us know when it arrives. It will.

gray davis is an idiot.

You did not say that nearly loud enough. Also, I think he heard about some luxury yacht tax that had been imposed and he figured he would try the same thing.

As for the drop in car sales, that is exactly why I was waiting. My wife and I are off to the dealership tonight. Likely will be driving home with a new one.

Excellent! It's always good to see Californians buying new cars. Of course it helps the economy, but it's good to know Californians are peospering, despite the unfreindly business climate.

Well, I was not intending to pay cash for the car but things are okay business wise. That's not because we are doing business in California though. We pulled our business out of California years ago. California is now just a bedroom communuity/state. My commute to work is a 12 hour flight.

I doubt they seriously thought that. They're just spoiled brats who throw tantrums when they don't get their way.

Interestingly enough...many of these people are the same people who don't like George W. Bush. I don't like the way he spends...but he was a 1000% better choice than Al Gore would have been.
