Sorta. The Framers attempted to create a republican form of government with limited powers; one which requires a difficult amendment process to lawfully obtain new powers. Our government, however, has ignored the law and obtained new powers via usurpation, initially via the usurpation of majority rule, and lately via judicial fiat.

Agreed. But that's what happens when the other two branches of government defer too much to judicial diktat.
