Oh this is just too much fun already. Mark Geragos has his nerve suggesting other people are in this "for the money". He must be concerned there won't be all those millions left for his salary... PS...Jim..thank you so much for the spell check!!

Wouldn't it be just if the FBI were taping Geragos for obstruction of justice going back years ?

The only way to get this country back on track is for the government to prosectute lawyers that defend guilty people.

At this point I believe the whole taping incident is staged by Geragos as a distraction and to provide him with an excuse for a press conference and get his face into every home.

Weren't there rumors that Geragos defended Susan McDougall in exchange for sex?

More likely Geragos leaked the story of the upset MJ wanting to fly to South America, then followed it up with these tapes of his calmness himself.

I smell some Clintonism here. Remember all the leaks (spread by the Clintons of course) in 1999 about BC's grand jury testimony video? The rumor was that his behavior was damaging and he got all flustered and angry at the grand jury. Tape is finally shown and voila! Nothing of the sort happened. Made the impeachment crowd look stupid.

I think there's the possibility that Geragos and Jackson either arranged to have the tape made, or, knowing that they were being taped (probably said so in the charter agreement), leaked the rumor that Michael was throwing fits on the plane to make him seem perfectly normal later and further blur the central issue.

it doesn't say that if a lawyer defends someone that he can risk going to jail if he loses.

I think the Clinton story was actually about his behavior at his deposition,, not the Grand Jury

I think it was the deposition for the Grand Jury. I remember the rumors of the red-faced Clinton storming out. Ex41 was so cold and calculating. The dumb attorneys let him take breaks, give speeches instead of answer questions, stop for soft drinks and then, just as the questions from the Grand Jurors started, Clinton's lawyers said, so sorry the time we promised you is over.

There certainly weren't any Dem senators coming out the next day apologizing for Ex41's behavior....like Sen. Hatch did today on the memo leak.

It is illegal for a defense attorney to defend someone as innocent when he knows the defendent is lying and guilty. IOW (I ain't good at legalese) a defense attorney who knows his client "did it" and claims the perp innocent is committing a crime as well. So from what I've heard, defense attorneys sometimes don't want to hear anything the defendent says in regards to their guilt.

Different if they're doing an insanity defense or ameliorating circumstances.

Putting both parts of your #22 together, I really think that you were being funny- but humor does not go over well on FR unless there is a silly "sarcasm" tag or a "wink" made out of punctuation symbols attached to it.

I have the same "problem"- people are always trying to flame me for my sarcastic posts- which they read superficially and take seriously.

I have a LOT of fun with them!

That is incorrect. Remember in a criminal trial the defendant does not have to prove he's *innocent*, rather the state has to prove he is guilty.

So the defense attorney can move to supress evidence, tear into and impeach witnesses, argue that the state has not met its burden of proof, do any of those things. Indeed, not only is it legal, it is his ethical duty if he undertakes a defense. To do less and he could be disbarred.

There is a line and this is it: If he knows that the defendant is going to perjure himself, he can't put him on the stand to do it. But that often is not a big drawback, because if he did put him on the stand his priors might come in.

That is correct, the lawyer is not the judge and jury. It is up to the state to provide the evidence of his guilt. If they can't do that they cannot get a conviction.

Defending a guilty person against improper prosecution is one thing.

Entirely ignoring the guilt of the defendant,in order to "win" a fight against law and justice for the guilty client may be the popular view of the role of a lawyer,but it is not the correct role of a lawyer.

Lawyers without ethics have made our legal system what it is today, a mockery of justice.

At some point, this insanity must stop.
It may take amother revolution, but it must stop.

The first non-violent grassroots effort to affect change is to vote NO, on every single judicial retention election, every time.
The next step is to never ellect anyone with a law degree to any position of power, anytime, anywhere, for any office.
