"...vote NO, on every single judicial retention election, every time." I have been doing that, and counseling others to do it, for years. The good judges will do just fine in the "private sector" for awhile- and we need to get rid of the bad ones altogether.
Too bad that this problem is just not on most folks radar screen at all.

A tabloid reported that Jacko went crazy on the flight, demanding diversion to South America, etc. If true, any tapes of his ride would make for interesting viewing. Pass the popcorn.
I'd (maybe) pay a buck or two to see that...A wigged-out little bitch panicky demanding his charter pilot to take him to Brazil.
This whole thing shows how nuts society has become.

For hundreds of years the English common law had, and has given us what is called an "adverserial" system. In such a system it is the lawyer's duty to zealously represent his client, it is his correct role. His role is not to act as finder of fact, that is for the judge/jury.
Now other countries have other systems for finding facts at a trial, like the French do.
Perhaps you would be more comfortable under their system rather than under ours?

It is often quite fascinating to see where these threads lead. There is a sort of "random walk" effect in these eposts, which possibly could be statistically quantified.
Anyway, who would have thought that a story about a (probably bogus) taping of Michael Jackson would lead to a serious discussion of the proper role of a defense attorney in our legal system?
For the record, I sat and listened to a woman at voir dire, last year when I was called for jury dury in a criminal trial, who absolutely COULD NOT GRASP the idea that the State has to PROVE guilt (and the defendant does not HAVE to "prove" his innocence. She was instructed by the judge several times in this fairly elementary principle- but was finally sent away, still believing that "If the police arrest somebody, then he must be guilty of SOMETHING".
Pretty scary.

It shows up most clearly at the end of the government's case when the defense moves for acquittal. It is "So what, they haven't met their burden, and no reasonable jury could find that they had".
Sometimes the motion is granted, defense never having to put on a case.

I am suspicisous of the Jackson team and lawyers putting the cameras in. Remember all the delaying when he would return. It was the next day he returned. They are smart people, then they could use the expose' as they are doing?
