Judge allows Hinckley to have unsupervised trips

WASHINGTON - A federal judge said Wednesday that the man who shot President Reagan could make unsupervised visits with his parents away from the mental hospital where he has lived for more than two decades.

A Justice Department official, speaking on condition of anonymity, said U.S. District Judge Paul L. Friedman issued the order granting John Hinckley Jr.'s request

Hinckley, 48, has lived at St. Elizabeths Hospital in Washington since he was acquitted in 1982 by reason of insanity in the shootings of Reagan, presidential press secretary James Brady and two law enforcement officers. Reagan was nearly killed and Brady was permanently disabled. Hinckley said he shot Reagan to impress actress Jodie Foster.

During five days of hearings, psychiatrists testifying for Hinckley, the government and the hospital said his mental health had improved to the point where he would not be a threat to himself or others if he were to leave the hospital for visits with his parents.

But government lawyers opposed the request, insisting that the would-be assassin was still dangerous and trying to deceive his doctors.

Hospital officials have said there have been no problems with Hinckley on his supervised trips to such places as a bowling alley, the theater and a shopping mall. The Secret Service watches Hinckley whenever he leaves the hospital grounds.

The psychiatrists said allowing Hinckley to leave unsupervised was the next step in his recovery from his mental illness.

Reagan's family and Brady's wife, Sarah Brady, have opposed Hinckley's request. Sarah Brady sent a letter to the judge. Reagan's children, Patti Davis and Ron Reagan Jr., made their opposition known in the media.

Crazy or not, he should have been put down within a week of his arrest.

Any word from Sara Brady and the gun-grabbing crowd? After all, Brady was shot as well, and was confined to a wheelchair for LIFE.

Sarah blames the gun, not Hinckley, so she shouldn't have any problem with the release. Heck he might go shoot someone else famous and give her some leverage to take away more of our Second Amendment rights.

Once you get well, THEN you can start prison time (minus whatever time was spent getting well enough to go to prison).

No. He was never sentenced to a prison term. He was sentenced to stay in a mental hospital until such time that he was no longer a danger to himself or others. I believe even the government shrinks in this case said he should be able to go on the visits.

Hinckley should never get out. I hope this decision is appealled and reversed.

The only people who might have standing to appeal it would be Ronald Reagan, and he's in no shape to do it, although Nancy could on his behalf, and Jim Brady. Sarah's not about to do it on Jim's behalf, since it was the gun, not Hinkley that was at fault in her mind.

If that's the case (I'll take your word for it), then the screw-up happened before he ever left the courtroom. What the hell kind of sentence is that?

That was the sentencing scheme. Some laws have changed since then, but at the time the law in that jurisdiction was that if you were not legally sane at the time of the commission of the crime, you could not be held legally responsible for your crime. You were not found guilty, hence no jail sentence. You were civilly committed as anyone shown to be mentally incompetent can be.

Last I heard, they were reviewing the decision. It'll probably take them a couple days or so to reach a decision. But I'd sure like them to appeal this one.
