This, the Padilla, the 9th Circus will make it all the easier for Bush, and more importantly, GOP Senate candidates, to pound home the point about Judges next year

Correct, assuming the GOP Senate will actually make an attempt to drive this point home

It's time for this thought to start circulating like wildfire. Courts that come up with goofy rulings need to be ignored. There need not be any appeals etc. Just simply ignore them.

Agreed. If they want to legislate from the bench, them them try enforcing from the bench while they're at it.

I believe the President should go one step further and send the detainees back to Afganistan where they can arrange for the lawyer of their choice...I'm sure the Afgani's will hold off long enough for that.

Maybe these judges timed this bad news to try to blunt the good news of the Saddam capture. Unlike Albright, I'm not joking when I suggest that such a thing is possible.

Actually, I'd just shoot all the Gitmo detainees, then arrest the judges for treason, give them a drumhead court martial, and shoot them, too.

Brave men fought and died to capture these b@st@rds! A military tribunal is the only sane way to handle this.

we need a 15 year term limit for all federal judges, across the board, all the way to the supreme court. lifetime appointment to the bench is akin to living on the rule of kings.

This is from a three judge panel from the 9th Circuit. The bottom line about this ruling: the panel has stayed the issuance of its mandate pending the U.S. Supreme Court's resolution of a case presenting this very same issue.

Don't have a cow. It's the 9th. Here's the URL to a 79-page PDF opinion:

don't count on it.

I will, though :) I'm no lawyer, but from just what I've read already there's so much wrong with this ruling that you'd have to throw out the legal system to reconcile not overturning it.

Did the 9th Circus also rule that Gitmo lies within the geographic boundaries of the 9th Circuit?
