Law doesn't give a hoot (ESA-Endangered Species Act)

What's the difference between a ferruginous pygmy owl living in Arizona and a ferruginous pygmy owl just across the border in Sonora, Mexico? If you answered, "nothing," you've just shown more common sense than either the geniuses in Washington who wrote and passed the Endangered Species Act 30 years ago this month or their successors who enforce the law today.

Great post, Norm! Another of the tactics is, of course, to declare that a gaggle of whatever species is the "southernmost" or "easternmost" population of whatever critter, and so must be "protected." Of course there ALWAYS has to be a "southernmost" population of ANYTHING. But a lot os sheeple buy the "threat." Sigh.

On the California coho scene, they are attempting to abandon genetics and use the relative isolation of streams as a basis for designating separate populations. We attempted to negotiate and incidental take permit with the State in anticipations of the final State listing, and they said they could not give us one for adult coho since a "take" would jeopardize the species (defined in terms of the Scott River population only.)

The ESA is a magnificient Trojan Horse used by statists to impose government control over private property. Hitler would have loved the ESA as a tool for the state to impose its will. Imposed on innocent property owners by sock puppet Marxist judges, the eco-fascists use the ESA to suck the life from property, telling owners they can't develop property because some critter "might" find a dry mudhole a suitable home.

The fascists have crossed the line and need to be shoved back.
