If it is a crime that dictates possible jail sentence then a jury of his peers will need to decide this. This man is responsible for his OWN ACTIONS and noone else!

Does it worry you in the least that the prosecutors didn't have even one provable fact of Rush breaking the law before they decided they needed to see Rush's med records?
The prosecutors are the ones doing the "shopping". They have failed to prove any of the first 3 speculative accusations they lobbed out, so now they are going fishing for anything, and violating Rush's right to privacy in the process.
Is this Gestapo tactic OK with you?
