"I think its pretty clear the guy is a crank (he won't let his dog and cats outside???)" That is a good point, especially considering that a cat's sense of smell is 11 times as sensitive as a human's and a dog's is even more sensitive, and yet, neither dogs nor cats seem terribly bothered by smoke as long as it isn't in their face. I think most of these terminal whiners are simply responding dutifully to the conditioning of the smoking nazis.

Odors from farting are just as obnoxious as smoking odors Actually I consider another person's fart much more obnoxious than smoking odors. Smoke can be washed off or masked with a bit of perfume, but that fart gets in your nose hairs and stays there. Yeeecch!
But I cannot control my neighbor's farts. I cannot control my neighbor's diet. I cannot control my neighbor's alcohol consumption. Nor should I expect to control any other behavior or habit I may or may not approve of.
When did we cross the line in this country? Exactly when did the right to control the actions of my neighbor join the right NOT to be offended?
Lastly, when are we going to take back our country? I am 50 years old. I do not need the government, liberal left, or any other busy body telling me how to live my life or raise my children. I make decisions and take risks knowing full well the consequences may not always be pleasant. I have to live with the consequences, no one else. I do not welcome the do-gooder, public-service announcement trying to put a fullcourt press guilt trip on someone because he/she smokes and has (GASP!!!) children. Nothing will ever change until we demand change.
Sadly, it seems we are content to complain while holding our ankles 24 hours a day.

why didn't the dumbasss judge just tell the old fart to go home and shut up or move??
my neighbor is from just south of cleveland (he moved here a few years back) and this moron can't get along with anyone. everything he does is fine, but everything anyone else does is wrong!! he has called the sheriff dept so much with "neighbor" complaints that the "high Sheriff" himself paid him a visit and told him if he called in anymore "bs" complaints, he was going to arrest him and charge him with filing false and malicious complaints and ask the court to order him to pay restitution for the deputy's time coming over there all the time.
this guy is just a plain idiot and a chickensh*t to boot. I am going to submit him to guiness as the world's worse neighbor.
And, yes, we have tried to get along with him, but to no avail. He will be nice when he needs something, but a horse's patoot when he isn't in a bind.

This particular case is not really the same as the "smoking in restaurants" thing. Here we have a guy on his OWN private property, who cannot escape the fumes from the renter next door. Ya know what, this is why we will never own property adjoining another. I mean, really, unless you had no choice why on earth would you buy a home where you can control what happens on the other side of the wall???

I think people can be accomodating, but there IS a limit. This reminds me of schools that outlaw peanut butter because one kind is allergic to peanuts.

MY BBQ is going all the time and wafts to the street, thankfully when my neighbors walk by they dont gripe...they say MMMmmmmmm LOL, even on the coldest of days let one person in my neighborhood decide to BBQ...2 hours later the whole block smells like a steakhouse. mmmmmmmmm is right.
