On Monday, the city's new mayor, Gavin Newsom, announced that a ban on same-sex marriage was unconstitutional More than anything, I'm a supporter of the rule of law and I'm wondering what in California state law or the California state constitution allows a mayor to simply declare state laws unconstitutional? Not a judge, not a legislature, not even the state governor, but a local mayor?

I'd wager it would be on Wednesday, except that it's already happened.
Two dames who got a civil union in Vermont asked a court in Idaho (I think) to dissolve it. The court, for some reason was going to go ahead, not realizing both people were female (maybe a name thing) and then the Judge said, hold on, we can't dissolve what we don't recognize.
I admit, that's a pretty poor retelling, but it's a true story no matter how much I mangled it, being too lazy to google, sorry!

There is no authority for a mayor to just violate state law. Every local official has a sworn duty to uphold state law and the constitution of the United States. Because the mayor blatantly violated state law, he should immediately be kicked out of office or arrested.
Second, it's not up to the mayor to declare laws unconstitutional, but for the judiciary. The proper way to challenge the law was for some gay couple to try and get a marriage license, be denied, THEN file suit.

That just might put the quietus on the marriage rage among queers.

Newsom should be prosecuted. He is encouraging people to commit a crime in the state of California -- not the city of San Francisco.
These people truly believe they are married with all of the benefits and perils.
That in mind, what will their employers do? Will they accept it? Will they be sued if they don't?
