But not everyone is convinced that the case, called Ex Parte Quirin, stands on firm judicial ground. A Congressional Research Service analysis of the Quirin decision completed in late March quoted two of the justices who participated in the case as expressing reservations about the court's actions.

Justice Felix Frankfurter wrote in 1953 that "the Quirin experience was not a happy precedent." And Justice William Douglas in a 1962 interview said: "The experience with Ex Parte Quirin indicated, I think, to all of us that it is extremely undesirable to announce a decision on the merits without an opinion accompanying it. Because once the search for the grounds, the examination of the grounds that had been advanced is made, sometimes those grounds crumble."

Military trial for US citizen?

Personally I think it's quite dangerous ground to establish that a citizen of a state of the union can be picked up and called an 'enemy belligerent'. Mind you I 'feel' Padilla should be hung if found guilty, but I'm not sure I would want that precedent set if another administration were in power

Listening to Ralph Nader on Meet the Press this morning - he says Americans are tired of the two party system, and ready to vote their consciences instead of for the corporate-dominated system.

Also fussing about how hard it is for 3rd parties to get on the ballots and get noticed.

I do note that in the last election, more of those who "voted their conscience" rather than for the 2 party system voted for Nader than all others combined.

On that we can agree. As I said, I'm just wary of a military tribunal judging any citizen of any of the 50 states

Good observations!

What I don't get is that most Republicans already know that their party no longer stands for conservatism, yet all they can do is simply ridicule and insult those who offer another alternative.
