That's been precisely my point for the last week. Thanks for finding the statute.
Troops, not lawyers. It's beyond time to enforce the law. Those who think that calling out the National Gurard to make arrests at the San Francisco courthouse is too extreme, that we need to go to full extent of legal recourse before taking action while thousands of couples get "married" (over 6,000 people by now), only to have them later become annulled, have witlessly (I hope) abetted the full blown riot likely to result. This situation should have been nipped in the bud for the benefit of all concerned.
If Gavin Newsome thought the law unconstitutional, he could have simply sued and tested it before adopting the route of civil disobedience via an act of dictatorship. He didn't need to put these people through a tragic emotional loop. For that action alone, he is neither compassionate or principled, but incontinent and despicable. That Arnold has let it get this far, AND has pitched to Lockyer the opportunity to throw the State's case, is nearly as bad.

Report From City Hall:
I was just there a few minutes ago (7:40 am). There were about 50 people lined up to go in. LEO's were at the front of the line.
Across the street in the park were Fred Phelps people protesting.
I talked to one of them, told them I lived there and that I was against this and so were other San Franciscans. Then this happened:
An older well dressed female told them "You ought to be ashamed of yourselves". I retorted "Why, the mayor is flouting the law."
A gay bald headed short guy in his 40's was screaming at them "You don't belong here, you don't live here, get the f*ck out of here!", then was phoning people on his cell phone.
I left quickly. I work for the gov't I can't afford to be seen as a Republican here. They WILL fire me for that.
