First, I was careful to distinguish the two, but I also
mentioned evidence that he's pro-affirmative action judge, and if he's squishy on that, how 'conservative' is that?

So you cant say you havent heard evidence that he's not conservatives. I've given you some.

Besides, Smith has performed well as the incumbent. Why should we in effect 'fire' him? Because he is *too* Conservative? Because his staff has too many conservatives? That's a nutty reason to dump someone in a Republican primary!

I just got off the phone with an activist and campaign guy who is helping some candidates (ie Garcia). He ran into Paul Green at an event. Green was talking about the need for 'an hispanic on the Texas supreme court' and was pro- affirmative action in his comments to some people there.

So according to hearsay, Paul Green is in favor of racial diversity among elected officials; I certainly wouldn't expect him to be opposed to it! And he supposedly supports "affirmative action" -- or opportunity -- in what form, who knows.

And so one individual part of his philosophy may or may not be questionable.

Besides, Smith has performed well as the incumbent. Why should we in effect 'fire' him?

Smith is a big fan of primaries. That's how he got the job. If he's confident that he's doing a good job, he shouldn't worry. After all, nobody's going to vote against HIM because his last name is the 'wrong' ethnic origin!
