Refusing an alcohol test is an automatic DUI conviction in Wisconsin. It is my understanding that the first DUI is a traffic matter punishable by losing ones license for 3-9 months and a fine that cannot exceed $800. I don't think it goes criminal until after the first . . . . but I've been known to be wrong.

She supposedly registered at 1.2 but claims she only had a couple glasses of wine.
For some that is a few glasses of wine.
They say she took some prescription medication that only requires a little bit of alcohol to make you drowsy, etc. Yet, she did register a BAC higher than the legal limit so who really knows?

At .6 most people would be in a coma or dead, so I would believe .12, but not 1.2.You're right, and I'm sorry for not correcting it sooner. I originally posted based on what the radio narrator said and he did say "1.2".

Consequences withstanding, legalized drunk driving would absolutely eliminate drunk drivers!
Roadside, state sponsored, drunk driver executions would work too!

I do wonder why she didn't have a driver or, if hubby was in the car w/ her, why he didn't drive? The cab would also have been a better option than this. At the same time, she may not have been aware of the effect of combining alcohol with the pill she took earlier.

I do wish Biskupic had won. His brother is the US Attorney for Milwaukee and he ain't playin', as a few local pols and bigshots have recently discovered the hard way. The last US Attorney here basically slept while a lot of crap was going on.

Peggy didn't let them draw blood; that 0.12 is based on a preliminary breath test. Thing is, in Wisconsin, you lose your license for a year (and a lot longer if you've had 3 previous DUIs) on top of any DUI conviction if you refuse ANY chemical test ordered by the cop.

Yes, Biskupic is a excellent atty. He would have focused on criminals and political corruption. The present AG is in, because she is soft ignores political shenanigans, drug laws and uses the office to promote green/socialist bench legislation.
It looks like the job is over her head. She should have called her husband to pick her up when she first noticed she couldn't drive.

According to the state policies on use of state (that is, taxpayer-funded) automobiles, use of same in the impaired state in which the Attorney General chose to drive is grounds for disciplinary action "up to and including discharge."

If my wife, children, or close friend calls me at any time of the day as a result of drunk driving, expecting me to save them some humiliation by giving them a ride home, they will be sadly mistaken.
They will sit in jail until they appear before a majestrate or judge. If they are ROR after posting bond, they can call a cab.
