Only a constitutional amendment will rein in the lawless judges.

However I agree that we can and we should keep the focus on fixing the judicial branch of government.

Maybe we need a "Judicial Interpretation Amendment"?

THE JUDICIAL POWER IS RESTRICTED TO INTERPRETATION OF THE LAWS AND THE CONSTITUTION AND IS NOT THE PLACE FOR MAKING SOCIAL POLICY FROM THE BENCH ...

or words to that effect.

The problem is that the author appears to assume that the courts in various states will rule according to the law of their own State Constitution. I don't trust that they will, and think a Constitutional Amendment may be our only hope, repugnant as the idea may be.

Amendments are like guns.

You only use them when you absolutly have to.


Without the amendment process we are defenseless against the judiciary (and law school indoctrination)

Now, you know that is not true. Tancredo and over 100 other Republicans have formed the immigration caucus and are onto this issue.

We need to stick together to stop them. I have no doubt that deep down, G W Bush is on our side.

Correction: 2/3rds vote in House and Senate, then on to 3/4 of the States to approve.

Very high bar. But I think we can at least get it out of the Senate and House ... WE SHOULD PUSH FOR A VOTE THIS YEAR.

Your exactly right about Rosie. If people listen to W you hear a very calm well reasoned man, while Rosie continues to scream that he is "vicious and hateful". People are getting sick of these in-your-face activist name callers, such as her and the mayor, and it's backfiring on them. Hopefully, next week the charade will end.

I see this as a nice wedge issue for our side and it needs to be done anyhow.

The courts will simply FUBAR it unless SCOTUS hammered it away ironclad which is not going to happen with this court.

Even if SCOTUS nails it, there is nothing to stop it from being undone by court packing or some other means.

The most permanent solution we have is the amendment process. The only way for that to be undone is for another amendment.

That will happen on the same day they undo the other 27.

The deadline is just to give finality. It can be done as fast as the public will allows.

In theory, it could be done before november.

Generally they give 7 years time limit.


I think the homosexuals are trying to spin a downside to saying marriage is one man and one woman. That somehow keeping marriage the way it has been for 6000 years of recorded history will cause a "problem".

The public seems to have become even less receptive toward gay marriage in the past seven months.

Or maybe CBS' polling got a little better, and they decided to warn Kerry and the DNC to stay away from this hot potato. My guess is that Kerry "flips" on the US Constitutional Amendment before the convention.

Blacks stand with Republicans on school choice and gay marriage? It's time for them to get off the liberal plantation...

Nearly all of those black voters who would not consider such a candidate are opposed to legalizing gay marriage.

actually I see civil unions going away. Civil unions are usuless to them without federal recognition. They need to be able to tap into the tax code and into social security.

They have cohabitation agreements. Have had for decades.

They know the civil unions were for marriage without the "m" word. Or the ability to force marriage out of the law.

The continued existence of marriage as an institution is a threat to those that would base relationships on sexual acts.

AS people begin to calm down and think about same gender "marriages" they will realize that: you can't be a little dead, you can't be a little pregnant and you can't be against same gender "marriages" and against a constitutional amendment. This idiotic talk about not "messy" with the constitution makes me laugh. What were the amendments to term limit the presidency - Republicans and give 18 year olds the vote - rats? Please can the esoteric crap about "messy with the constitution". Isn't funny too, that some of the same people spouting that line are the same ones who have told us over and over again the the constitution is a "living document"?

I think you're correct about being beyond a states issues. This is now a Consitutional matter to make sure the courts know what the people want. This is spreading like wildfire and the is no court relief for those opposing the matter. Time for a Constitutional Convention, as spooky as that can be.
