SIOUX FALLS A federal judge has ruled that a lawsuit filed by former U.S. Sen. James Abourezk can continue against an Internet site that put Abourezk on a "traitor's list" for criticizing President Bush.
U.S. District Judge Lawrence Piersol denied a motion on Wednesday from ProBush.com to dismiss Abourezk's lawsuit. Abourezk, who was a Democratic U.S. senator from 1973 to 1979, accused the site of libel.
Abourezk sued last year after his name and photograph showed up on the list along with those of several others, including actress Susan Sarandon, Sen. John Kerry and Sen. Hillary Clinton.

Was Abourezk one of the guys involved in the Abscam bribery case? Hmmmm. (Checking Google to see if my recollection was right). No. But he was the guy that spread the (apparently false) rumor that Sen. Larry Pressler was gay in order to help defeat him. I'd say that there are Arabs you can trust, but Abourezk isn't one of them.
His Senate seat now belongs to that small American, Tommy Daschle.

It is obvious that a sitting judge (U.S. District Judge Lawrence Piersol) and former senator (U.S. Sen. James Abourezk) know nothing about our First Amendment Right to Free Speech, our American laws or the history of the country they live in. This is only the beginning of what these people are capable of.
It is bad enough we are at war, and we are vilified by third world mentalities at home and abroad. These people in particular are using their position by abusing the courts in order to deny the very existence of a private forum and its members the freedom to express their views without retalliation. These ingrates are public representatives who are effectively muzzling the taxpayers at their expense without so much as a rebuttal. Their acts are nothing short of being anything less than diabolical.
These two public individuals (and those of their ilk) should be held accountable for making a mockery of justice, and the offices they were trusted to hold on behalf of the taxpayers who pay their salaries and pensions. This case and these two individuals should be publicly exposed for the tyranny they represent where ever and when ever possible so that people may know and remember that our freedoms are as fragile in the USA today as they were in colonies more than 200 years ago.

This situation I'm afraid has the potential of really endangering this nation and putting an absolute chill on the expression of political opinion on the internet.
As I understand the rule of law, if what you're saying is simply an opinion of someone whose ideas you disagree with, there's no liability. But if you present something as fact rather than simply your own political opinion and it turns out to be false, then you're liable.
It seems like what we're doing here is creating a special class of people (Democrats) with the rights to be exempt from criticism. I'm afraid this concept is setting a very dangerous dicta and has the potential to seriously undermine the rule of law.
The rule of law is not about giving Democrats, liberls, progressives or moderates special or favored reatment over conservatives and christians but apparently there are those who seem to think otherwise and clearly this mindset is very malicious and harmful. Given what's been going on with our judicial system, I can tell you that I'm not very proud of it right now.
