While I agree that she needs to be questioned, what she said on CNN is not entirely incorrect (although VERY misleading).

The policies which created the wall betweeen Intelligence gathering and Law Enforcement go WAY back. The first formalization was the FISA act and thereafter the wall simply grew.

FISA made it extremely difficult to collect Intelligence data on "US Persons" (basically any person or organization legally present in the US). There were two tracks for investigations - criminal or intelligence - and the two were kept apart.

This memo again formalized the wall within the FBI and made clear how investigations were to be carried out. Gorelcik did NOT initiate this policy.

She is being very disingenious though when she states that she didn't "sign" it / author it. As with most documents of this type, the DAG probably DIDN'T write it. Instead she would have had her staff do it. She is still responsible for the content and any policy memos originating from her office.

The way I understand it, the Gorelick memo goes beyond what the law required, so she can't take the excuse that the law had been in effect for years before the existence of the memo.

Good points, however it all just emphasizes the need to have Gorelick on the other side of the table. She's not sounding like a commissioner in the CNN interview--she sounds like a witness.

She has a tough choice to make--remain on the commission and nullify its already fading credibility, or honorably resign as a conflict of interest matter and get on the schedule to testify. I won't hold my breath waiting for the latter to happen.

Look at page 2 of the memo. She very clearly states that her directive goes "beyond" what the law requires.

I disagree. The memo says the new procedures "go beyond what is legally required." She was taking a really bad statutory policy and deliberately making it worse. That's why she lied about signing the memo.

No, but as the memo clearly shows, she made the Wall a PRIORITY and even admits that she wanted the Wall to be observed BEYOND what was legally required. She is culpable, she does have a conflict and she MUST resign.
Any other course of action by the Comission indicates it is NOT intrested in a clear and open discussion of ALL the factors that lead to 9-11.

Your second paragraph is true enough....

..but necessary inlight of what Carter did to us, IMO.

But we all surely know X-42's administration (& jamie gorelick) used their wicked machinations to gin it up for their own evil reasons.
