If Moore actually has some additional footage of the murder of Ncik Berg, and is not lying through his teeth, here's how it can be handled. It is a federal crime for anyone, anywhere, to kill an American in a terrorist attack. The tapes are therefore "evidence of a felony."
The US Attorney with jurisdiction over wherever Moore is can summons him to turn over the tapes. If he does not do so, then he is guilty of "obstruction of justice." I think the Afministration should move on Moore -- those who take this blivit seriously will never support the Administration. Those who know that Moore is a lying pig will support the move.

Remember when Moore said he had people in Iraq doing filming for him? What if one of them was Nick Berg?
That is the only logical explanation that I can come up with.

If the US government refuses to persue charges against Michael Moore, there is always the chance that the newly formed Republic Of Iraq could extradite Michael to Iraq to face charges of collaborating with the terrorists who killed a man in Iraq. He'll have a whole lot of prison experiences to make a documentary about. Maybe he can be Iraq's Mumia.
