I'm I'm correct, there are a number of states that have a "resign to run" law, meaning that if you're a current office-holder and you're seeking higher office, you have to resign from your current position.
I believe Florida is one of those states.
On a side note, I could excuse a Senator (of either party) if they missed a FEW votes while running for President. But what Kerry is doing (87% of votes missed) is inexcusable and he ought to resign immediately...or pay back the Senate for the time missed.

Law student Johnathan M. Stein, 28, filed a complaint against Mr. Kerry of Massachusetts for cashing the pay checks and Senate Secretary Emily J. Reynolds for not deducting pay for his absences.It seems extremely odd to me that a law student has to enforce the law through a complaint! What the hell is the Justice Department doing???????
