AP: Clinton Adviser Probed in Terror Memos

WASHINGTON - President Clinton (news - web sites)'s national security adviser, Sandy Berger, is the focus of a criminal investigation after admitting he removed highly classified terrorism documents from a secure reading room during preparations for the Sept. 11 commission hearings, The Associated Press has learned.

Berger's home and office were searched earlier this year by FBI (news - web sites) agents armed with warrants. Some drafts of a sensitive after-action report on the Clinton administration's handling of al-Qaida terror threats during the December 1999 millennium celebration are still missing.

Berger and his lawyer said Monday night he knowingly removed handwritten notes he had taken from classified anti-terror documents he reviewed at the National Archives by sticking them in his jacket and pants. He also inadvertently took copies of actual classified documents in a leather portfolio, they said.

"I deeply regret the sloppiness involved, but I had no intention of withholding documents from the commission, and to the contrary, to my knowledge, every document requested by the commission from the Clinton administration was produced," Berger said in a statement to the AP.

Berger served as Clinton's national security adviser for all of the president's second term and most recently has been informally advising Democratic presidential candidate John Kerry (news - web sites). Clinton asked Berger last year to review and select the administration documents that would be turned over to the commission.

The FBI searched Berger's home and office with warrants earlier this year after employees of the National Archives told agents they believed they witnessed Berger put documents into his clothing while reviewing sensitive Clinton administration papers, officials said.

When asked, Berger said he returned some of the classified documents, which he found in his office, and all of the handwritten notes he had taken from the secure room, but said he could not locate two or three copies of the highly classified millennium terror report.

Many are stored that way. But that is always an ongoing process....so no telling how far the back log is. I have used documents in research that were not that new...but were still in paper(copied and sent to me) form. But a lot goes up quickly on electronic data bases. And we are talking about classified stuff here. Surely the documents at issue here would be a priority.

Did I read correctly? Are there still Classified docs. missing?!

Crimony, what was Berger thinking? There has to be some connection to the Klintoons. Why else would Sandy risk all of this??? He is not a stupid man.

"technical violation of Archive procedures, but it is not all clear to us this represents a violation of the law,"

Excuse me! It was an ONGOING investigation by the freaking 9/11 Commission! He withheld documents from them!

You have to ask yourself if Clinton knew about this. I don't see how he couldn't have.

Is it anybody else impression, that the 911 Commission, which the Democrats were planning to use to nail Bush, is blowing up in their faces?

I agree with you that this has been known but kept hidden for several months.

But I don't agree with your scenario.

I think it was a sting operation set up by this administration. First, let us agree that they got Berger on video. He wouldn't be admitting to deliberately stuffing crap in his underwear if they couldn't flip a switch and show him in the act. As for the brief case, well I don't think they got this on tape which is why he is saying "inadvertantly". They know what documents are missing and they know they've been missing since Berger did his burglary. They've got a "before" and "after" inventory for this deed. I don't understand about the briefcase. Would they let him take a brief case in that room? Maybe he had a plant inside the archives and somehow he marked the documents to be pulled when he went through them but couldn't stuff them in his underwear because of the size. The plant might have pulled the documents Berger somehow indicated.

Sounds to me like the Bush admins figured something like this might go down and had a plan. Which doesn't make me unhappy by the way. It's no secret that this 9/11 commission was orchestrated to blame the attacks on Bush and deflect it from the Clinton administration.

Okay, so now, why did this factoid get leaked now? Could it be that the 9/11 commission is ready to release the final report and the time was rife for a convenient leak of this sort to be forthcoming?

It's amazing the warrant to search Berger's house has been kept secret this long. The leak of the info was intentional and was done for this timing, whatever it is-the Dem convention or the commission's report.

This will be big news soon enough. No way it will be kept under wraps.

WTH? So he deliberately steals some docs, and accidentally steals others? This is so not good.

What's (still) missing, and who had/has it?

Of course he stays on; not even stealing national secrets could be enough to humiliate a Democrat!
