WASHINGTON - President Clinton (news - web sites)'s national security adviser, Sandy Berger, is the focus of a criminal investigation after admitting he removed highly classified terrorism documents from a secure reading room during preparations for the Sept. 11 commission hearings, The Associated Press has learned.

Berger's home and office were searched earlier this year by FBI (news - web sites) agents armed with warrants. Some drafts of a sensitive after-action report on the Clinton administration's handling of al-Qaida terror threats during the December 1999 millennium celebration are still missing.

Berger and his lawyer said Monday night he knowingly removed handwritten notes he had taken from classified anti-terror documents he reviewed at the National Archives by sticking them in his jacket and pants. He also inadvertently took copies of actual classified documents in a leather portfolio, they said.

"I deeply regret the sloppiness involved, but I had no intention of withholding documents from the commission, and to the contrary, to my knowledge, every document requested by the commission from the Clinton administration was produced," Berger said in a statement to the AP.

Berger served as Clinton's national security adviser for all of the president's second term and most recently has been informally advising Democratic presidential candidate John Kerry (news - web sites). Clinton asked Berger last year to review and select the administration documents that would be turned over to the commission.

The FBI searched Berger's home and office with warrants earlier this year after employees of the National Archives told agents they believed they witnessed Berger put documents into his clothing while reviewing sensitive Clinton administration papers, officials said.

When asked, Berger said he returned some of the classified documents, which he found in his office, and all of the handwritten notes he had taken from the secure room, but said he could not locate two or three copies of the highly classified millennium terror report.

Kerry's brother and another campaign worker pleaded not guilty to charges of "breaking and entering with the intent to commit grand larceny."

After the arrests, candidate Kerry told the New York Times that the break-in was a pre-emptive strike in response to threats that phone lines to his campaign headquarters were about to be sabotaged.

Cameron Kerry is now a partner in a Boston-based law firm and has been a key financial backer of all of his brother's campaigns."

All I'm saying is that any glee over this should be tempered with our experience of how the MSM spins crime and treason to the left's advantage, as well as "our" side's typical jelly-doughnut-like response to these events. This is the same gang of the "inadvertent" 900 FBI files. Most of the public really has no understanding of document classification levels and security of them, and it'll be easy for the left to spin this into "well, he was the Nat'l Sec Advisor, so what if he took them."
I'd love to see Berger/Clinton et. al. brought up on conspiracy, obstruction, what have you. Let's hold our breath -- you go first.

You bet it is, The Bush Administration knew in advance of the documents taken and the sting was setup during the interview.

Now I know why the Democrats are being so silent about Joe Wilson being trashed by the media, they're scared to death

Oh, they've got copies, all right.

I'm loving this, and thank goodness for FR, because the television media is particularly poor so far on this. I saw the Fox News update. No mention of Berger hiding docs in his clothing!

I think the notes are a ruse for the missing docs. Used the notes as a cover story if he got caught. The auditors of the archive caught him, and I doubt they were missing some notes.

He knew what he was doing, why else put the stuff in your pants.

Maybe so but WHY was Berger willing to do something this risky? Must have been a very compelling reason.

Obviously because of the content of the documents. Which shows right there he wouldn't just take documents because Bill told him with an eye to ruining Kerry. No, Berger knew the content, he knew the implications for Clinton and it is the content that they wanted to hide. None of this other nonsense that this is Hillary's plot to bring down Kerry. Absurd.
