Michigan Supreme Court overturns $21 million medical malpractice verdict

LANSING, Mich. - The Michigan Supreme Court on Friday tossed out a $21 million medical malpractice verdict against a Dearborn hospital, saying the jury had no basis for deciding that a doctor's error caused a baby to develop cerebral palsy and other neurological problems.

The court, in a 6-1 ruling, overturned the judgment and ordered a lower court judge to enter a verdict in favor of Oakwood Hospital in Dearborn and the doctors involved. Justice Marilyn Kelly dissented.

A Wayne County jury awarded the $21 million verdict in 1997, after Kimberly Craig sued, alleging her son, Antonio, then 13, was born with brain damage that left him a quadriplegic.

If only the Michigan Supreme judges could be transplanted to where "Cerebal Falsy" Yung Edwards slick talked juries into multimillion dollar payoffs. Years of scientific data now prove that Edwards was wrongfully awarded money and he should be forced to return it.

I don't know the merits of this case so I can't comment on it but I can tell you this, my entire family knows if anything happens to me and I am not able to state what hospital I chose to have my care in, they are never to send me to Oakwood.

More like cerebral stinker.. this man made his bucks by just such a gimmick as this case describes. if I'm not mistaken.

Good analogy. Have heard/seen John Stossel all over the place recently talking about Edwards & his cases (& how they led to the increase in the use of Caesarian sections...w/o any drop in the % of resulting cerebral palsy cases).

We should forward this to the kerry-edwards campaign - that is how the weasel made his money, and got rich. by the way - edwards never took a case 'pro-bono'.
