Just doing things that an enemy can use against America doesn't meet the standard for 'aid and comfort'. It takes something like providing financial/material support, or information of direct military use.

Consider all those Republican Congressmen who committed treason (by your standard) by voting to impeach the Commander in Chief even as he struck at America's enemies in Iraq! Surely that must have been a great and useful comfort to Saddam.
