The big question would be how long would it take for the USSC to hear the case? I think you are correct but think about this. The 9th also found that the 2nd doesn't apply to individuals... If a Bush appointed USSC hears the case it may put an end to that debate once and for all in the favor of the truth and the Founding Fathers.
