Judge Rules Against Patriot Act Provision

NEW YORK (Reuters) - Part of the Patriot Act, a central plank of the Bush Administration's war on terror, was ruled unconstitutional by a federal judge on Wednesday.

U.S. District Judge Victor Marreo ruled in favor of the American Civil Liberties Union (news - web sites), which challenged the power the FBI (news - web sites) has to demand confidential financial records from companies as part of terrorism investigations.

The ruling was the latest blow to the Bush administration's anti-terrorism policies.

In June, the U.S. Supreme Court (news - web sites) ruled that terror suspects being held in places like Guantanamo Bay can use the American judicial system to challenge their confinement. That ruling was a defeat for the president's assertion of sweeping powers to hold "enemy combatants" indefinitely after the Sept. 11, 2001, attacks.

This will be upheld on appeal. Terrorists have been posing as Muslim charities for years and the FBI needs this information for the war.

With all of the "charities" that were funneling money to terror groups, how can they strike any part of the Patriot Act. This makes me sick.

For U.S. District Court Judge Victor Marrero, the private sector doesn't begin to compare with public service.

"Not financially, of course," Marrero said Tuesday to a group of 20 students at Third Avenue North residence hall before heading to the Torch Club for another lecture.

Marrero, a 1964 graduate of NYU who was an undersecretary of the Department of Housing and Urban Development under President Carter and U.N. ambassador under President Clinton, fondly recalled his time as program director of New York's Model Cities urban development project in the South Bronx.

"My work in the city was sort of front-line work, dealing firsthand with the problems of the poor community," he said. "Seeing the programs that we implemented, using the monies that were given for the South Bronx, was just fulfilling."

Before being appointed in 1999 by Clinton as a federal judge to the Southern District of New York, Morerro specialized in environmental law, real estate law and land-use law.

His career has allowed him to view different aspects of the court system, he said.

"It has been very interesting to see the development of law and legal principles from the practitioner's side, who tries to shape the law in accordance with the interests of the private parties, and from the point of view of the judge, who tries to interpret the point of the law," he said.

Marrero's talks were part of the Distinguished Alumni Series, which is co-sponsored by the Division of Student Affairs and the Office of Alumni Relations. •

I WOULD LIKE TO ADDRESS EVERYONE THAT HAS A DEMOCRATIC SENATOR UP FOR RE-ELECTION. THE ONLY WAY TO STOP CRAP LIKE THIS IS FOR ALL OF US TO GET THE OBSTRUCTIONISTS DEMON-CRATS OUT OF OFFICE. THEY WON'T VOTE FOR GOOD JUDGES, THEY ARE HINDERING ALL THE GOOD THAT CAN GET DONE IN AMERICA

A federal judge in New York shot down the Palestinian Authority's legal defense strategy in a $500 million terrorism lawsuit, declaring that the Palestinian claim of sovereign immunity does not hold up in US court.

"The court is not prepared to find sovereign immunity where none exists," wrote Judge Victor Marrero in a 62-page decision in which he denied a motion to dismiss the suit, which was brought by the family of Aharon Ellis against the PA, PLO, and a slew of top Palestinian officials accused of terrorist ties.

Judge Marrero was appointed to the bench by President Clinton on October 5, 1999 and assumed office on December 1, 1999.
