SYRACUSE, N.Y. The New York attorney general's office plans to dissolve the charity founded by a Muslim doctor on trial for illegally sending money to Iraq, seize its assets and turn them over to another charity, a federal prosecutor said Monday.
Assistant U.S. Attorney Michael Olmsted said in court that officials with the charities bureau of the state attorney general's office plan to file a lawsuit in state Supreme Court to take over Help the Needy.
Dr. Rafil Dhafir, 56, of Manlius, is accused of setting up the unlicensed charity and sending money to Iraq in violation of prewar sanctions. He also is charged with defrauding Medicare out of $274,000 through his former Rome oncology practice and evading $400,000 in federal income tax payments by writing off the illegal charity donations.
The charity is charged in federal court with sending at least $160,000 to Iraq. Dhafir is being tried separately. His trial is scheduled to start Tuesday.
Help the Needy currently has $225,000 in assets.
The state can dissolve a charity when it has broken the law or failed in its charitable mission, according to Winthrop Thurlow, the assistant attorney general in charge of the Syracuse office. He declined to comment on any actions against Help the Needy.
The U.S. government got a court order to freeze the charity's assets in February 2003.
Under an earlier proposed settlement between Help the Needy's lawyer and federal prosecutors, the charity's assets were to be shipped to humanitarian needs in Iraq as part of a settlement of criminal charges. The state's intervention would end that settlement.
Dhafir's lawyers have maintained their client always wanted the money to go to the children of Iraq.

Strange that when you find a terrorist, the ACLU is always the first to arrive.
