In this case, the ACLU should be upheld. Broward screwed up and failed to mail absentee ballots to tens of thousands of voters. The deadline should be extended for those voters, even if it leaves the outcome of the whole election in doubt for a couple more weeks. This is one of the rare times I find myself in agreement with the ACLU. Of course, if Bush is ahead in Florida by, say, 100,000 votes at 2 am, it would be pointless to delay certification of the result.I agree with you 100%. I didn't like it when Rendell pulled tricks on the overseas soldiers (while push-polling the prisons) because the state was late in getting out the ballot. Rendell had to make good; so should FL. Same principle. Happily, it looks like it won't make a difference in either state and put the results in doubt.

Good analysis - thanks. you done the same for Ohio yet. I'm concerned ablut Ohio - if Bush gets it, he's got the Prez....if not touch and go.

IMO, even if the judge is a card-carrying communist, he's not going to delay certification if it's clear that these absentee votes can't affect the outcome.
I truly hate to say this, but I think it's high time that the federal government steps in to regulate the elections in Broward and perhaps in Dade and W. Palm Beach. This is a federal presidential election these incompetents are disrupting with their antics and they're doing this for the second time. Enough!
