Dear Friend:

Thank you for contacting me regarding judicial nominations in the newly-elected session of Congress. It is an honor to serve in the United States Senate.

The Constitution's "advice and consent" clause clearly gives the Senate the prerogative to accept or reject any of the President's judicial nominations. Unfortunately, a minority of Senators have been using Senate rules to stop the confirmation of many of these nominees and thwart the will of the majority. Their unwise and dangerous efforts are unprecedented and must not be allowed to succeed. That is why I have taken several steps to address this attack on our Constitution and judicial system. On June 5, 2003, I proposed a narrow change to Senate rules that would prohibit long term filibustering of judicial nominees. On November 12 - 14, 2003, I held the Senate in session for almost forty straight hours — the longest continuous debate in over 10 years — to force the minority to defend their actions.

I believe that the American voters sent a very clear and stunning message in the November 2, 2004, elections. That is why, as I begin work as Majority Leader in the 109th Congress, I will continue to work to ensure that President Bush's judicial nominees receive fair treatment. I am sure the President will continue to nominate judges who believe in protecting the rule of law, and I am confident that the Senate will be able to confirm these judges in the 109th Congress. Activist judges who make law instead of interpreting law undermine the rule of law. It is imperative that the Judiciary Committee approve the President’s judicial nominees and send them to the Senate floor for an up-or-down vote.

Rest assured, I will continue to fight for fair treatment of the President's judicial nominations. Anything less is unfair to the nominees, the President, the integrity of the judicial system and the American people.

Last week I wrote an e-mail to Senator Frist and several other members of the Senate Republican Leadership concerning the disasterous possibility of Arlen Specter being seated as the chair of the Senate Judiciary Committee. I received this disappointing reply. This is obviously a form letter that the Majority Leader's office sends to anyone contacting them about issues involving the Judiciary. Senator Specter's name is never mentioned nor is the current blowup involving Specter's unwise comments to the press.

Unfortunately the pressure seems to be easing a bit on Senator Specter and I now believe that he will be chosen as the next head of the Judiciary Committee. I realize that talk radio and the net is still calling for his head, but the MSM and even Fox News are now claiming that Specter has talked himself out of this problem and will likely be given the chairmanship. Judging from the tone of Senartor Frist's response, I'm beginning to think they're right.

Did anyone else receive any other letters of this sort? Just curious.

This cartoon is off the mark. It's like the Mets trying to tell the Yankees what's best. WIN something, then tell us when we're screwing up. The judiciary is an issue that lasts for decades, centuries even. Can't get any more important.

I personally called all the members of the Judiciary Committee yesterday and let them know that Arlen Specter taking the Chairmanship position would not be good. Also, left word to "Bork Specter."

In response to this statement on the constitution, I would think that the argument against the senate filibuster or threat of filibuster is that the constitution gives clear right to the Senate to vote up or down, it does NOT give any rights to 'block' a vote. If the Senate abdicates its responsibility by a filibuster, the president can and should easily be able to fill the seats. Why is this not so?

If they put Specter in and it's the "same old, same old" game - Republicans will lose for sure in 2008.

They're only shooting themselves in the foot by trying to appease Democrats and moderate Republicans.

I will not vote in 2008 if this administration fails to listen to the constituents supporting morality - who put them in office. And I strongly suspect I will not be alone.

Let's just say that Frist is no Tom Delay. He wants to be liked by the MSM...the affliction of too many GOP politicians who are too dense to get the fact that the media hates them.

Well, they're misguided. Because we won, and because we have a mandate, we can apply pressure at will on our own guys. We can afford to do it. So they can laugh all they want, the dumb losers.

Meanwhile, we're looking after our p's and q's.

While I like Senator Frist I too believe he will not make it out of the primaries should he choose to run for POTUS. He doesn't seem to have any real fight or fire in him.
At least none that I have ever heard!!!

It's only easing for now.. But on Tuesday, the Senators are back in Washington - get ready to act!
