I suspect you're right - and that even there, the fight will be less over replacements for conservatives such as Renquist than over liberals or even moderates whose replacement could tip the court truly conservative.

What I find worrisome about SCOTUS nominations is the fact that Bush has an ambitious agenda to get thru the Senate. The more eager you are to get things done, the more effective a fillibuster is against you. Democrats in a 45-55 minority and without the WH/VP are going to be in a defensive posture and not expecting to accomplish all that much so they will not be hurt by the inability of the Senate to get things done.
