Senator offers bill to outlaw spanking: Canadian parents who paddle subject to assault charges

A Liberal Party senator in Canada has introduced a bill to outlaw spanking.

The bill, offered by Sen. Celine Hervieux-Payette, would remove the defense contained in the nation's criminal code for parents and educators who use corporal punishment, the Montreal Gazette reported. Without the defense, parents and teachers would be subject to assault charges for spanking children.

"It's not a means of education, it is a means of coercion that in certain cases causes irreparable damage that we can't tolerate in an evolved society that cares about the welfare of children," Hervieux-Payette told the paper.

Though other lawmakers have offered similar bills in the past, Hervieux-Payette is convinced she will succeed this time – largely because Prime Minister Paul Martin's government is in a minority.

"In a period of minority government you are less at the mercy of the government and more capable of going to all the political parties to get support because there is more power in the hands of parliamentarians in a minority government," she explained to the Gazette.

Hervieux-Payette claims prosecutors won't bother parents who administer an occasional slap, but instead will go after more severe cases.

In January, Canada's Supreme Court voted 6-3 to uphold the rights of parents to use "reasonable" force to spank their children and outlined guidelines for its use. At the time, two dissenting justices said the current law was vague and should be re-written by Parliament.

Commented Liberal MP Francoise Boivin, who supports the bill: "Society has changed a lot through the years."

This is stooopid. If this law were in effect when I was growing up, my Dad would have been an Ole Sparky candidate. Along with my camp councelors and the masters (teachers) in my English boarding school.

When my children were growin up, I always met with the teachers and gave them paddles with my children's engraved on the paddles. There was NEVER an issue with my kids being out of line in school. My daughter graduated Magna Cum Laude from Lehigh's School of Business.

And certainly NOT for the better.A good spanking is in order for any child that warrants it.There's a difference between beating a child and a spanking,and those who cannot tell the difference should be prosecuted.Kids thrive on attention from their parents,and they need to be shown that there are limits to their bad behavior.Too many buddies and not enough parents nowadays.
