Alright "stupid," join the club. I can tell you about corruption, greed, and a number of factors at play here, but when it comes right down to it, I don't get how this can be happening either. It's like an alternate universe. Terri seems to have fallen down the rabbit hole, and the queens keep yelling "Off with her head!"
It would be nice if this lifenews site would practice some of the basics of journalism -- who what when where how. They tell us who - - the parents -- but don't say when or where - - - specifically, WHAT COURT have they petitioned to change the woman's guardian"? If it's the same judge who refused to do so before, WHY WILL THIS REQUEST lead to anything different? Indeed, WHY WOULD THE COURT EVEN HEAR THIS REQUEST, if it's the same one request and the same court, as previously. Don't misunderstand, I want the "husband" booted as "guardian" --- but I'd also like to know the basics of what's going on, and this article doesn't supply them.
LOL! Glad I am not alone in my "stupidity", then. :) This whole situation does seem to have a lot of surreal qualities to it, for certain.
This certainly isn't a knock against Terri or her family, but I did a paper on this in my American Justice class my senior year of high school. In it, I discussed euthanasia, but concentrating specifically on the legalities of a living will. When I first heard about this, it immediately sprang to mind. I have had one ever since I wrote that paper, and updated it when I got married. Of course, I wrote the paper in 1994, well after this had happened to Terri. The more I learn about this case, the happier I am that I have one. It's a big relief to me. Additionally, I have made my husband, parents, siblings, and other family members aware of my wishes, just in case.
It would kill me to have my family go through what Terri and her family are going through now. It's just cruel, although it certainly is NOT her fault!!
I guess the "system" will keep everyone on a merry go round until the money runs out. Pathetic!
It is not primarily about the money...although that is extremely important.
It is about keeping Terri from being able to TESTIFY AGAINST MICHAEL!!!!! If she is DEAD, she cannot TESTIFY to a possible BOTCHED ATTEMPTED MURDER!!!!!
If Terri ever gets HER THERAPY MONEY so that she could get HER THERAPY (which Michael was awarded for HER THERAPY not Michael's legal bills), her communication/vocalization/cognative skills would probably improve significantly.
If Terri's communication/vocalization/cognative skills improved enough for her to be able to communicate sufficiently to law enforcement that Michael attempted to murder her that fateful night (a la Scott Peterson, OJ, Walker Railey, etc.), then Michael could face the DEATH PENALTY!!!
Michael must do ANYTHING and EVERYTHING he can to GET TERRI SILENCED FOREVER---i.e. DEAD---before such a scenario happens!!!
If Michael did botch an attempted murder, he cannot afford to allow Terri to recover, much less live...Michael needs her DEAD!!! And that is just one reason why TERRI MUST LIVE AND GET THERAPY!!!
Now if THAT isn't the pot calling the kettle black, I don't know what is!!! =/:o)

The way the law works, the same judge (Greer) will always be the one to handle the case. All their petitions will go before him once he took the case on (and won't recuse himself, although they have asked).
No one knows whether or not the court will hear this request, but considering that Judge Greer still has the guardianship case before him (that was filed in 2002), I think they are hoping to prod him into action. Perhaps by bringing a new motion, and because this is being handled by new lawyers, I think they are hoping to get some sort of review.
The Schindlers' lawyers have at least twice come close to getting Michael and Jodi deposed, but they are no-shows for the scheduled depositions, and Greer has yet to throw their rear ends in jail for contempt of court (which is what would likely happen to you or I if we failed to show up for a deposition)!
You do have a point. If they could bring up criminal charges against Michael, would that go before a different court or would the guardianship/probate court always get it? I don't know the answer to that.
You mention Walker Railey. You are the only other person besides myself that I know of who has mentioned that name and the similarity to Terri's case. I forget his (ex)wife's name. Is she still alive and being cared for? I haven't read up her lately. Do you know anything more?

I wonder if they'll ever be able to get anywhere with the law enforcement in their area. You've heard that Michael's future mother-in-law worked for the sheriff's office for years before her (untimely) death in August, haven't you? What a coincidence!
Amazing, too, that Michael and Jodi were called at that time to be deposed, and that Eleanor Centonze (Jodi's mom) was the "guard" on duty during the time they had Terri's feeding tube pulled last year. What she took with her to her grave! She got to spend precious time with Terri that wasn't even afforded to Terri's birth family! It's outrageous when you think about all the torture that Michael has inflicted upon Terri and her family over these last dozen or so years! Simply incredible!
Thanks... Terri's future is up in the air. Could be Jan. 21st or end of January that Greer orders her execution by starvation-dehydration.
I remember when it happened. I did a google search on Walker Railey recently (because of the similarity to Terri's cae), but did not notice anything current (I didn't look too long however).
Walker Railey's wife's name is/(was???) Peggy. I have no idea if she is currently alive or dead.
The Railey case, howeve, sounds VIRTUALLY IDENTICAL to Terri's case. I would not be a bit surprised if Michael didn't read up on the case immediately prior to Terri "suddenly" becomming mentally and physically disabled.
It is a very similar scenario. I'll probably do more searching on it in a bit. I feel myself getting ramped up for a big war!

There is a virtually identical case going on in Los Angeles Superior Court, Probate Division. Can you believe that the judge has ruled that this man may not see his attorney? There is a hearing tomorrow to determine if his attorney may meet with him in a neutral place alone with the attorney and a speech therapist.
The Schindlers are aware and supportive of this case. I will be reporting Saturday as to what happened. I already know I will be asking for help.
