The legal problem is that there is NO proof that Mapes/Rather forged the documents. All the evidence points elsewhere. They RECEIVED the documents (everyone seems to agree), so they can't be charged with forgery. Possession of forged documents would require scienter, which would have to be proved beyond a reasonable doubt. Hard to do in this case.
