Wait just a couple more days.

I have read virtually every single decision of the WA supreme court for the past 4+ years. I just have a feel for where each of the justices are going to come down on different cases.

About two weeks prior to the state supreme court issuing its opinion in 144 Wn.2d 30, SKAMANIA COUNTY v. GORGE COMM'N, I sent a letter to the state SC asking when the opinion would be coming out and predicted that the vote would be 9-0 or 8-1 in favor of Brian Bea. The decision was actually 8-0 with Justice Phil Talmadge not participating in the decision. Talmadge avoided participating because he was contemplating running for governor and did not want to tick off either the environmental wackos (whose positions he had supported in earlier cases) nor property rights proponents. I had also suggested that Faith Ireland, while supportive of the Gorge commission, was normally very adamant about complying with statutory time limitation periods and would vote against the commission on that basis.

I went on to suggest that the Gorge commission would not appeal to the USSC for fear that the USSC would affirm the WA SC. Such an appeal might have also raised the issue as to whether compacts between states are constitutional when they violate the property rights of individual citizens. I suggested that they would be unconstitutional.
