CA: 'Direct' evidence city manager saw Cisco red flag (Borgsdorf)

An independent investigator has concluded that there is ``undisputed, direct'' evidence that San Jose's top administrator knew of clandestine communication between his staff and Cisco Systems that tainted an $8 million technology contract last year.

The third report in two weeks issued by San Francisco law firm Hanson Bridgett contains some of the most damning e-mails to date connecting City Manager Del Borgsdorf to problems with the contract, which was ultimately voided because it illegally favored Cisco.

Included is an e-mail from Cisco about contract issues that Borgsdorf and his deputy, Ed Shikada, received June 22, three hours before the city manager assured the council that the procurement deal was clean of outside influence. Another set of e-mails shows that Borgsdorf had at least some awareness as early as mid-May of the concerns of a deputy city attorney who concluded the deal was improper.

In recent weeks, Borgsdorf has consistently denied that he knew of the lawyer's concerns or the inappropriate contacts with Cisco. Borgsdorf responded late Monday, blasting investigator Mike Moye for selectively connecting the dots and mischaracterizing the evidence at hand, he said.

``His conclusions are wrong, and they are not supported by the facts in the report,'' Borgsdorf told the Mercury News.

Moye's surprise findings, released at 5 p.m. Monday in the form of an 11-page analysis with 40 pages of e-mails, time lines and other attachments, deepened the dilemma for a weary mayor and council anxious to put the scandal to rest, but faced with mounting questions about the city manager's credibility.

Borgsdorf had in recent days appeared to have beaten back questions about connections between his deputies and the scandal, but the newest revelations go directly to him.
