S.J. council closes probe of tech deal - City Manager, Attorney survive scandal

Saying they remain deeply troubled, San Jose City Council members nonetheless voted overwhelmingly Tuesday to end one of the broadest probes in city government history. Council members said they were unsure they'd ever find absolute proof top administrators were culpable in the city's bungled $8 million technology deal involving Cisco Systems.

The 9-1 vote -- Councilman Dave Cortese dissented -- orders the city's independent investigator to cease reviewing the Cisco deal and all but ensures City Manager Del Borgsdorf and City Attorney Rick Doyle will survive the worst scandal to rock San Jose government in 20 years.

A criminal investigation by the district attorney's office, however, is ongoing.

In a final three-hour debate, council members made clear that Borgsdorf and Doyle would not escape unscathed -- especially after a late-breaking report by the investigator Monday revealed additional evidence that the city manager and his staff probably were more aware of problems than they had admitted. In response, the council voted to haul Borgsdorf and Doyle into an unprecedented joint evaluation and to impose dozens of reforms designed to let the council ``trust but verify'' the two are doing their jobs.

`Questions will remain'

Cortese asked the council, if nothing else, to let the investigator submit a final report outlining any unanswered questions the investigator thought he could make headway on. ``I need that to have some semblance of closure on this,'' Cortese said at the meeting.

``There are new facts that arise from the latest report,'' Cortese argued. ``They could be relevant and informative to what I thought our original goals were -- to find out who lied and who misrepresented and why.''

But the council rejected his request.

The City Hall folks are going to let the voters elect a new councilman in June to replace the recently resigned Terry Gregory.
