To: PAR35

The legal consultant on FNC this morning is saying that the code is such that either the ICE agent had to be performing his duties as an agent, or that Nichols would have to have known he was a federal agent in order for it to be considered a federal offense. Yesterday, all the other legal consultants were all acting like that didn't matter. I guess we'll see.

Thanks. That's my understanding, but I haven't kept up with the changes under the Patriot Act and the other anti-terrorism legislation, so I am willing to retract my statements if someone can show me something I've missed.

A decent state prosecutor (even in Atlanta) ought to be able to load the guy up with 3 death penalites and a couple of life sentences, not counting the carjackings and the batteries, so I'm not worried about the guy getting off. f all else fails, Gwinnett ought to be able to get him a life sentence on the kidnapping up there.
