Hello Sen. Bray,
You are formerly put on notice that you will be held financially accountable for your vote if it contributes to the passage of a mandatory seat belt law in Missouri, as presently being report by KMOX radio in St. Louis.
Refer to:
Hafer v. Melo, 502 U.S. 21 (1991) State officers may be held personally liable for damages based upon actions taken in their official capacities.
The proposed mandatory seat belt law is blatantly unconstitutional, both a violation of the Missouri Constitution and the U.S. Constitution.
Missouri Constitution, Bill of Rights, not bill of privileges,
Article I
Section 2. That all constitutional government is intended to promote the general welfare of the people; that all persons have a natural right to life, liberty, the pursuit of happiness and the enjoyment of the gains of their own industry; that all persons are created equal and are entitled to equal rights and opportunity under the law; that to give security to these things is the principal office of government, and that when government does not confer this security, it fails in its chief design.
Section 4. That Missouri is a free and independent state, subject only to the Constitution of the United States;
U.S. Constitution, Bill of Rights, not bill of privileges,
Amendment IX
The enumeration in the Constitution of certain rights, shall not be construed to deny or disparage others (rights) retained by the people.
If this law passes, I will file a suit to have it declared unconstitutional. After that favorable ruling, I will then sue you for damages.
So, if you wish to put your home equity, savings, and future income on the line to support an unconstitutional law, then I guess I will see you in court.
Thank you for your time spent reading this e-mail message.
2006 legislative session: The word "not" is hereby stricken from Section 307.178.
Lookie here. :(
where are we at on this seat belt law now. i support your effort,i am a retired police officer,i know both sides,and i beleive it should be up to the person,if they want to wear a belt. You never see the figures on how many are killed or injuried wearing belts. I cant seem to get this info.,but it must be recorded someplace.
